Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Skyline Online LLC, a New Mexico limited liability company (“KinkChatRooms,” “we,” “us”), covering your use of kinkchatrooms.com and everything on it (the “Service”).

Section 14 requires individual arbitration and waives your right to a jury trial and to participate in a class action. You can opt out of arbitration within 30 days — see that section for how.

1. Accepting these Terms

By opening the Service, creating an account, or joining as a guest, you agree to these Terms. If you don't agree, leave the site.

The Service is a real-time adult chat platform: public chat rooms, private messages, media sharing, and webcam features. It is free of charge — there is no subscription, no paid tier, and no purchase of any kind.

We offer the Service to people in the United States, Canada, and New Zealand. We may block access from anywhere else at any time.

2. You must be 18 or older

The Service is strictly limited to adults 18 years of age or older.

By using the Service you represent that you are at least 18, that you have the legal capacity to enter this agreement, and that adult sexual content is legal where you are.

We verify age through AgeVerif, an independent verification provider. The check is designed to be double-blind:

  • We receive a yes/no attestation and nothing else — never your name, your date of birth, or a copy of any document.
  • The provider confirms your age but is not told which site you are visiting.
  • No verification data is kept by us after your session ends.

Trying to defeat or bypass age verification — including by using someone else's credentials or a false attestation — gets your access permanently terminated, and we will report it to law enforcement where the law requires it.

Parents and guardians: filtering software can block adult sites on a device. Options are widely available for phones, tablets, and computers.

3. Accounts

You can use the Service two ways, both free:

  • Registered account — you give an email address and confirm it. You sign in through a one-time link we email you, or through Google. We don't ask you for a password.
  • Guest access — no email. Guest accounts and everything attached to them are deleted automatically 24 hours after sign-up or last activity, whichever is later. Nothing about a guest account is recoverable after that.

One person, one account. You are responsible for what happens under your account and for keeping your email inbox secure — anyone who reads your email can sign in as you. Tell us at contact@kinkchatrooms.com if you think someone else got in.

Don't sell, rent, or transfer your account. Don't create an account to evade a suspension.

4. What you may not do

The full list of what's allowed and what isn't lives in our Community Guidelines — they are part of these Terms. Some rules are absolute, and breaking any of them ends your access immediately:

  • Anything involving minors. No sexual content involving anyone under 18, real or depicted. No sexualized discussion of minors. No attempt to contact, groom, or solicit a minor. No claiming to be under 18.
  • Non-consensual content. No intimate images or recordings of anyone who didn't agree to have them shared — including images of yourself with another person who didn't consent. No content depicting coercion or force presented as real.
  • Commercial sex. No prostitution, escorting, or trafficking — advertising it, arranging it, or recruiting for it.
  • Harassment and threats. No stalking, no threats of violence, no targeting someone after they've blocked you, no publishing someone's private information.
  • Hate. No attacks on people over race, ethnicity, national origin, religion, disability, gender, gender identity, or sexual orientation.
  • Illegal drugs and weapons. No offering, sourcing, or arranging sales.
  • Fraud, spam, and scraping. No scams, phishing, mass unsolicited messaging, bots, automated account creation, or bulk collection of other people's data.
  • Attacks on the Service. No probing, overloading, reverse-engineering, or interfering with the site or anyone else's use of it.
  • Impersonation. Don't pose as another person, as our staff, or as a moderator.

You also may not post content you don't have the right to post, or use the Service in a way that breaks any law that applies to you.

5. Your content

What you post stays yours. To run the Service we need permission to handle it, so you grant us a non-exclusive, worldwide, royalty-free license to host, store, copy, reformat, transmit, and display your content — solely to operate, moderate, and secure the Service. Nothing here lets us sell your content or use it to advertise.

That license ends when the content comes down, with two practical exceptions: copies retained in moderation records, and copies already delivered to other users' devices, which we cannot recall.

You represent that you have the rights to everything you post and that everyone appearing in it is an adult who consented to it being shared here.

If you send us feedback or a suggestion, we can use it without owing you anything.

6. Moderation, suspension, and termination

We moderate. That means human moderators, automated filters, and third-party screening services reviewing content and accounts. Section 8 says which services and what they see; our Privacy Policy covers the data side.

We may remove content, mute an account, restrict features, shadow-ban, suspend, or permanently ban — with or without notice, and at our discretion. We don't owe you a reason, though we usually give one.

Bans apply to your email address and to the device identifiers associated with your account, so they follow a new sign-up. We do not ban by IP address: mobile networks share addresses among many people, and an IP ban would hit uninvolved users.

You can delete your account yourself, any time, from your profile page. Two things you should know before you do:

  • A suspended account can't be deleted — otherwise deleting and re-registering would erase a ban. Write to us if you want to contest a suspension.
  • Deletion removes your profile, your private messages, and your uploads. Your room messages stay, detached from your account and no longer attributed to you. Connection records also survive for their retention period. The Privacy Policy spells this out.

If we terminate your account, sections 5 (the license, as limited above), 9 through 15 survive.

7. Copyright — DMCA

If you own copyright in something posted here without permission, send a notice to legal@kinkchatrooms.com identifying the work, the URL where it appears, your contact details, and a statement that you have a good-faith belief the use isn't authorized. We remove infringing material and terminate repeat infringers. Our DMCA Policy sets out the full procedure, what a valid notice has to contain, and how to respond if your content came down by mistake.

If intimate images of you were posted without your consent, don't wait on a copyright notice — write to contact@kinkchatrooms.com with “urgent removal” in the subject line. We treat those first. Our Content Removal page says what to put in that email and what happens next.

8. Third-party services

The Service depends on outside providers to work and to stay safe: media storage and delivery, transactional email, image and text screening for illegal content, proxy and VPN detection, city lookup, email deliverability checks, sign-in through Google, and audio/video relays for webcam. Our Privacy Policy names each of them and what it receives.

The Service also renders links other users post, including YouTube previews. We don't control those sites, we don't endorse them, and their terms — not ours — govern what happens once you go there.

9. No warranty

The Service is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage.

We don't promise the Service will be uninterrupted, secure, or error-free; that messages or uploads will be preserved; that moderation will catch everything; or that other users are who they say they are. You are talking to strangers on the internet. Use your judgment, especially before sharing anything identifying or meeting anyone offline.

Some states don't allow certain warranty disclaimers, so parts of this section may not apply to you.

10. Limitation of liability

To the fullest extent the law allows, neither Skyline Online LLC nor its members, managers, employees, or providers is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of the Service — even if we were told such damages were possible.

Our total liability to you for any claim relating to the Service is capped at one hundred U.S. dollars ($100). The Service is free, so this reflects the absence of any payment between us.

We are not liable for what other users do — what they post, what they say, or what they do with what you share with them.

Some states don't allow these limitations, so parts of this section may not apply to you. Nothing here limits liability that cannot be limited by law.

11. Indemnification

You'll defend, indemnify, and hold harmless Skyline Online LLC and its members, managers, and employees from any claim, loss, liability, or expense — including reasonable attorneys' fees — arising out of your content, your use of the Service, your breach of these Terms, or your violation of anyone's rights.

12. Governing law

These Terms and any dispute arising from them are governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules. Where section 14 doesn't apply, the state and federal courts located in Bernalillo County, New Mexico have exclusive jurisdiction, and you consent to that venue.

13. Informal resolution first

Before starting arbitration or any proceeding, write to legal@kinkchatrooms.com describing the problem and what you want. Give us 60 days to work it out. Most things end here, and the deadline for filing is paused while we talk.

14. Arbitration and class action waiver

Read this section carefully. It affects how you can bring a legal claim against us.

If we can't resolve a dispute informally, you and we agree that it will be settled by binding individual arbitration, not in court. This covers any dispute relating to these Terms or the Service, under any legal theory, including claims that arose before you accepted these Terms.

How arbitration works

Arbitration is administered by the American Arbitration Association under its Consumer Arbitration Rules, in effect when the claim is filed. One arbitrator decides. The hearing takes place remotely, in the county where you live, or in Bernalillo County, New Mexico — your choice. The arbitrator can award the same individual relief a court could, and the award is final and enforceable anywhere. The Federal Arbitration Act governs this section.

Class action waiver

You and we may bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is found unenforceable as to a particular claim, that claim — and only that claim — goes to court, and the rest of this section stands.

What's excluded

Either of us may bring an individual claim in small claims court if it qualifies. Either of us may also seek injunctive relief in court to stop infringement or misuse of intellectual property. Nothing here stops you from reporting a matter to a government agency.

How to opt out — 30 days

You can reject this arbitration agreement. Email legal@kinkchatrooms.com with the subject line “Arbitration opt-out”, including the email address on your account and a statement that you decline arbitration. It must reach us within 30 days of the date you first accepted these Terms. Opting out costs you nothing and changes nothing else about your access — sections 12 and 13 still apply.

15. Changes to these Terms

We may update these Terms. When we do, we change the “Last updated” date at the top of this page, and for material changes we give notice on the site before they take effect. Continuing to use the Service after that means you accept the new Terms. If you don't, delete your account.

16. Everything else

  • Entire agreement. These Terms, the Privacy Policy, and the Community Guidelines are the whole agreement between us about the Service.
  • Severability. If a provision is unenforceable, the rest stays in force.
  • No waiver. Not enforcing a provision once doesn't waive it later.
  • Assignment. You can't assign these Terms. We can, in a merger or sale of the business.
  • Force majeure. We're not liable for delays or failures outside our reasonable control.
