1. Who makes what you see here

Every photo, video, voice message, cam broadcast, and profile picture on this site arrived through a user account. There is no other way in.

• We don't produce any of it. Nobody here shoots explicit content, commissions it, scripts it, directs it, or asks anyone to post it.
• Nobody is paid for what they post. There is no creator program, no revenue share, no paid contributor, and no account that gets anything in return for uploading.
• We don't feature, rank, or promote anything. No editor's picks, no front-page gallery, no staff selection of any kind. A room shows what the people in it posted, in the order they posted it.
• We're not a party to what gets filmed. Cam sessions run between the people in them. We relay them and we don't record them, so nothing survives the broadcast — the same thing our Law Enforcement Guidelines tell investigators.

2. Why we are not a producer

Part 75 defines who has to keep records, and it also defines who doesn't. Section 75.1(c)(4) excludes anyone whose part is limited to transmitting, storing, hosting, formatting, or translating material someone else made — provided they don't select it and don't alter its content.

That is an exact description of what happens to a file here:

• It gets stored. An upload goes to storage and comes back out to whoever opens the message. Nobody reviews it on the way in to decide whether it deserves a place.
• It gets reformatted, automatically. Images produce a small preview thumbnail, videos are re-encoded so they play in a browser, and voice messages are converted to a format phones can read. Machines do all of it, on every file, with no one looking. A conversion that makes a file play on a phone is formatting — it's named in the regulation, and the frames are still the ones that were uploaded.
• Moderation removes; it never selects. A moderator can take something down. There is no button that puts something up, boosts it, or arranges it. Taking material away is the opposite of choosing it, and a service that removes what breaks its rules hasn't thereby picked what stays.

None of that is a favor we're doing anyone. It's a description of a chat service, and it's the reason the record-keeping obligation sits where it sits.

3. We keep no section 2257 records

So we don't keep them. There is no set of identity documents held here for anyone appearing in user content, no index of legal names against usernames or file locations, and no inspection point — because the duty that would create them applies to producers, and we aren't one. We'd rather write that down than leave you to work it out.

Why we don't want to hold that material either. Keeping those records means collecting a government ID and a legal name for every person visible in every upload, then holding all of it. We don't ask for any of it, we don't have it, and a pile of identity documents attached to sexual images is exactly the kind of thing that should not exist. Our Privacy Policy lists what we actually collect, and it's a much shorter list than that.

This doesn't move the duty anywhere — it locates it. If you produce sexually explicit material and post it here, section 2257 applies to you as its producer, and those records are yours to keep. Nothing on this page, and nothing about us hosting the file, changes that.

4. What the person who uploads promises

Posting here is not unconditional. Our Terms of Service section 5 sets out what you agree to the moment you upload something — that the material is yours to post, and that everyone appearing in it is an adult who consented to it being shared here. It's linked rather than repeated, so the promise you accepted and the promise on this page can't drift apart.

Our Community Guidelines say the same thing from the other end: section 2 on who is allowed to be here at all, and section 3.1 on minors, which is the rule this site enforces ahead of every other one.

Breaking that promise ends the account. That's section 6 of the Terms, and it doesn't depend on any record we keep.

5. If you think someone in content here is under 18

Use the report button on the message or the profile and pick the Minor reason. Those reports are handled ahead of everything else. If you can't report it in the app — you're not signed in, or the content is already gone — write to legal@kinkchatrooms.com with as much detail as you can give: the username exactly as it appears, the room or whether it arrived in a private message, and the date and rough time with your time zone.

Images uploaded here are checked against a database of known child sexual abuse material before anything is stored, and a match means the file is never written to our storage. That check runs on uploads; it isn't a substitute for someone telling us what they saw. Section 3.1 of our Community Guidelines has the full rule.

6. Intimate images posted without consent

Different problem, different channel, and a faster one. If intimate images of you are on this site and you never agreed to them being here, our Content Removal page is the route to use — those requests are handled first. Don't send it as a copyright claim, even if you took the photo yourself and own it outright.

7. Where to write

Questions about this statement go here. It's the same address as section 17 of our Terms of Service:

Email is the fastest route and the one we recommend. Mail reaches us, but a letter spends days in transit.

8. Changes to this page

We may update this page. When we do, we change the “Last updated” date at the top, and for material changes we give notice on the site before they take effect.
